1. Coverage
Ngenco Limited warrants that for a period of five (5) years following application, Ultra-Fast shall be free from material defects in design, material and workmanship including but not limited to:
discolouration, staining, cracking, blistering and delamination.
2. Conditions of warranty
2.1. Ultra-Fast must be applied by an Authorised Ngenco Installer in accordance with the prescribed application instructions. Defects arising out of failure to correctly apply Ultra-Fast are not covered by this warranty.
2.2. The purchaser must ensure that checks of the product application are carried out every six (6) months by the original Authorised Ngenco Installer and logged in the warranty booklet.
2.3. The purchaser must retain the original warranty booklet and a copy of the original invoice identifying the applied coverage.
3. Claims procedure
3.1. The purchaser’s sole and exclusive remedy for breach of this warranty shall be to return to the original Ngenco Authorised Installer and discuss the replacement or rectification of the defective product.
3.2. To make a claim under this warranty, the purchaser should contact the Ngenco Authorised Installer centre where the application was performed. In the event that the purchaser is unable to contact the original Ngenco Authorised Installer, the purchaser should contact Ngenco Limited head office by telephone on +44 330 024 5981 or by email at warranty@dubai.ngenco.com.
3.3. The original warranty booklet and a copy of the original invoice must be provided to Ngenco in order to process a claim.
3.4. The purchaser must notify the Ngenco Authorised Applicator within a reasonable time of discovery that the product does not comply with the warranty.
3.5. The purchaser must allow the Ngenco Authorised Installer to examine the car and Ultra-Fast product in order to determine whether the product is defective.
3.6. If the Ngenco Authorised Installer determines that the product is defective, Ngenco will arrange for an Authorised Installer to remove and reapply Ultra-Fast to the areas covered by the warranty at no charge to the purchaser, including parts and labour.
3.7. Refunds will be at the sole discretion of Ngenco Limited, the issuance of such credit or refund shall be up to the original purchase price of the defective area of the application.
4. Exclusions
4.1. This warranty does not extend coverage to defects arising out of the following:
a) neglect or negligence of the purchaser.
b) alterations to the product.
c) damage caused by natural disasters.
d) abnormal road debris impact.
e) accidents or collisions.
f) intentional damage of any kind.
g) failure to apply Ultra-Fast in accordance with the prescribed application instructions –
no substitutions for reducers/thinners, catalysts/hardener or additives may be used. Mix ratios and application instructions must be followed to ensure the product meets program standards.
h) applications carried out by anyone other than a Ngenco Authorised Installer – these products are designed for application only by professionally trained personnel, using proper equipment, and are
not intended for sale to the general public.
4.2. This warranty is non transferrable and is valid to the original purchaser only.
5. Limitation of liability
5.1. Nothing in this warranty shall limit or exclude Ngenco Limited’s liability for fraud or fraudulent misrepresentation, breach of the terms implied by section 12 of the Sale of Goods Act 1979 or defective products under the Consumer Protection Act 1987, or any matter in respect of which it would be unlawful to exclude or restrict liability.
5.2. Subject to clause 5.1 above:
a) Ngenco Limited’s total liability to the purchaser in respect of all losses arising under this warranty shall in no circumstances exceed the purchase price of the application.
b) Ngenco Limited shall under no circumstances whatsoever be liable to the purchaser including in negligence, for any loss of
profit, or any indirect or consequential loss arising under or in connection with this warranty.
c) No representative or agent of Ngenco is authorised to give any guarantee or warranty or make any representation contrary to this warranty.
d) No waiver, alteration, addition or modification of the foregoing conditions shall be valid unless made in writing and signed by an executive officer of Ngenco Limited.
5.3. Ngenco Limited reserves the right to remove or add products to its list of Ultra-Fast products covered by this guarantee at any time.
